NEW YORK (AP) — A Pennsylvania man who overdosed on Nexium in New York City has been charged with second-degree murder and is under a criminal investigation.
Michael J. Sullivan, 41, was charged with dealing with a mixture of drugs that caused his death, according to police.
According to court records, Sullivan pleaded guilty to a misdemeanor charge of introducing an opioid drug into interstate commerce, in exchange for money, as well as possessing a controlled substance and other documents. He was scheduled to appear in New York City on February 18.
The case was investigated by the United States Postal Inspection Service, the New York Attorney General’s Office, the United States Food and Drug Administration and the Federal Bureau of Investigation.
Sullivan pleaded guilty to introducing an opioid drug into interstate commerce in 2009, according to the case documents.
The case was prosecuted by the New York Attorney General’s Office and was prosecuted by Assistant United States Attorney Michael A. Ryan.
In January of next year, Sullivan pleaded guilty to one count of conspiring to deliver the drugs to New York City and one count of introducing and using a controlled substance in exchange for money. He was also ordered to pay $100,000 in restitution for his role in the conspiracy. He faces a maximum penalty of 20 years in prison and a $250,000 fine.
Sullivan’s attorney, Michael J. Coughlin, says that while prosecutors believe Sullivan may have used drugs to promote his health, “we don’t think he would have committed any more crimes.”
Sullivan has been charged with one count of dealing with drugs that caused his death, and one count of introducing and using a controlled substance.

NEXIUM 24HR TABLET should be taken as prescribed by a doctor. It can be taken with or without food, but it is better to take it at a fixed time. The dosage is determined by your medical condition and response to treatment. The maximum recommended dose is one tablet per day. Always follow your doctor’s instructions and to use this medication as prescribed by your doctor. Use this medication for as long as your doctor has prescribed you. Do not stop using this medication without consulting your doctor.
Adults (over 18 years): Take 1 tablet (20 mg) per day. Do not exceed this dose. Keep the medicine away from children or if they are sick.
Children under 18 years: Not for use in children under 18 years of age. Do not take in children under 10 years. If you have a medical condition that may make this medication less effective or get allergic to esomeprazole, use esomeprazole with caution.
Elderly: Do not take in children and adolescents (below 18 years) having osteosarcoma, because the risk of bone loss may be higher with the use of esomeprazole.
Precautions
This medication is not for use in children under 18 years of age. Keep the medicine out of reach of children. If your child has esomeprazole-associated hypercalcemia or hypertriglyceridemia, find the right time to take this medication. In case you or your child have become pregnant, discontinue the use of esomeprazole and consult your doctor. Avoid contact with eyes. Tell your doctor if you become pregnant or if you become unwell.
